Terms of Service

1. Agreement

By accessing or using Spatiq ("Service"), operated by Humziq (SMC-Private) Limited ("we", "us", "our") at spatiq.app, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Spatiq is a SaaS platform that enables merchants to create augmented reality (AR) product catalogs. The Service includes AI-powered 3D model generation, QR code creation, a shareable AR catalog viewer, and scan analytics. Features vary by credit pack purchased.

3. Accounts

You must register for an account to use the dashboard. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. Accounts are for businesses or individuals acting on behalf of a business.

4. Credits & Billing

Spatiq operates on a pay-as-you-go credit model. Credits are purchased in packs and consumed at a rate of one credit per AR model generation. Credits never expire and are non-transferable between accounts.

Credit packs are priced in USD and charged in PKR at the exchange rate applied by SafePay at the time of payment. Prices are listed on the pricing page and within your dashboard.

Payments are processed by SafePay (Safepay Private Limited), a PCI-certified payment gateway operating in Pakistan. By making a purchase you agree to SafePay's terms of service. Humziq (SMC-Private) Limited remains the merchant of record for all transactions.

Credits are added to your account automatically and instantly upon payment confirmation. You will receive an email receipt confirming the transaction and your updated credit balance.

We reserve the right to change credit pack pricing at any time. Price changes do not affect credits already purchased.

5. Refunds

Please see our Refund & Cancellation Policy for full details. Credit packs are generally non-refundable once fulfilled. AR generation failures are automatically refunded to your credit balance.

6. Cancellation of Orders

Because Spatiq credit packs are digital goods delivered instantly upon payment confirmation, orders cannot be cancelled once credits have been applied to your account.

If you believe a purchase was made in error and no credits have been used, contact us at info@spatiq.app within 24 hours of the transaction with the subject line "Order Cancellation Request" and your SafePay transaction reference number. We will review the request and, where eligible, process a full refund via SafePay within 7–14 business days.

Cancellation requests received after 24 hours or after any credits have been consumed will not be eligible for a refund. See our full Refund Policy for details.

7. Customer Complaints

We are committed to resolving customer concerns promptly and fairly. If you have a complaint about the Service, a transaction, or any aspect of your experience with Spatiq, please follow the process below:

1. Submit your complaint by emailing info@spatiq.app with the subject line "Customer Complaint". Include your account email, a clear description of the issue, and any supporting details (screenshots, transaction IDs).
2. Acknowledgement: We will acknowledge receipt of your complaint within 2 business days.
3. Resolution: We will investigate and provide a resolution or update within 7 business days of acknowledgement. Complex cases may take longer; we will keep you informed.
4. Escalation: If you are not satisfied with our resolution, you may escalate by replying to the same email thread requesting a senior review. We will respond within a further 5 business days.

All complaints are handled by Humziq (SMC-Private) Limited at the registered address above. We treat all complaints confidentially and use them to improve the Service.

8. Acceptable Use

You agree not to:

• Upload content that is illegal, infringing, defamatory, or harmful.
• Use the Service to promote or sell prohibited goods (weapons, illegal substances, etc.).
• Attempt to reverse engineer, scrape, or abuse the API beyond its intended use.
• Use the Service in any way that could damage, overload, or impair its infrastructure.
• Misrepresent your identity or the origin of your products.

We reserve the right to suspend or terminate accounts that violate these terms without notice.

9. Intellectual Property

You retain all rights to the product content (images, descriptions, metadata) you upload to Spatiq. By uploading content, you grant us a limited, non-exclusive license to store, process, and display it solely to deliver the Service to you and your customers.

The Spatiq platform, including its software, design, and AI pipeline, is owned by Humziq (SMC-Private) Limited and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the platform without our written consent.

10. Data & Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated 3D models are provided as a best-effort output and may not perfectly represent your products — you are responsible for reviewing them before publishing.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Humziq (SMC-Private) Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you for any claim shall not exceed the amount you paid to us in the three months preceding the claim.

13. Termination

You may close your account at any time by contacting us at info@spatiq.app. We may suspend or terminate your account if you breach these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or for legitimate business purposes.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the dashboard. Continued use of the Service after the effective date of updated Terms constitutes acceptance.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Pakistan, without regard to conflict of law principles. Any disputes shall be subject to the jurisdiction of the courts of Karachi, Pakistan.
